S. 744 - The Senate Immigration Reform Bill

S. 744, the "Border Security, Economic Opportunity, and Immigration Modernization Act," contains several positive reforms for the immigration court system, including: reducing immigration court backlogs, ensuring judicial review, providing real administrative review, providing counsel to particularly vulnerable immigrants, guaranteeing immigrants’ access to their own records, protecting immigration stipulating to their removal, and expanding the Legal Orientation Program (AILA Doc. No. 13041760).

A fair and functioning court system is essential to ensuring due process. Currently, the immigration court system is plagued by a lack of funding. While Congress has appropriated ever increasing sums of money to the Department of Homeland Security for immigration enforcement and detention, the immigration court system remains severely underfunded.
