  • ARB Finds H-2A Employer Must Pay Untimely Certification Fee Yet Reverses Debarment Order (Updated 1/9/13)(575 KB - 1/9/2014)
    DOL's Administrative Review Board (ARB) affirmed the ALJ's finding that the employer’s withdrawal of its application for H-2A workers after OFLC granted the certification did not excuse its obligation to pay the fee, yet reversed the debarment order. (OFLC v. Castro Harvesting, 11/26/13)
