AILA and Partners Submit Amicus Brief on Detention During Withholding-Only Proceedings
AILA and other groups submit an amicus brief to the Eleventh Circuit in Radzhabov v. Barr urging to affirm the district court’s decision finding that the detention of individuals in withholding-only proceedings is governed by the pre-final order detention statute, 8 U.S.C. § 1226(a), and that, therefore, they have a right to a bond hearing in which an immigration judge (IJ) will consider their release pending resolution of their fear-based claims.
