District Court Certifies Class and Rules in Favor of Plaintiffs in EB-5 “Indebtedness” Case
Granting class certification, the court found USCIS’s policy of treating loan proceeds as “indebtedness” that must be secured with investors’ personally-owned capital was arbitrary and capricious, and remanded denied I-526s denied on that basis for readjudication. (Zhang v. USCIS, 11/30/18)
