AILA's Refugee and Asylum Committee highlights some resources from DOJ's Immigrant and Employee Rights (IER) Section that may be useful to AILA members and their clients:

  • Protecting Your Right to Work

The INA prohibits employers from discriminating against U.S. citizens and other work-authorized individuals based on their citizenship, immigration status, or national origin. This IER flyer provides general information about the law and provides examples of employer discrimination and of unlawful discrimination in the E-Verify process.

  • Telephone Interventions

IER's telephone intervention program is a form of alternative dispute resolution. It allows a caller to IER’s worker or employer hotline to work informally with IER’s staff to resolve potential immigration-related employment disputes within hours or minutes, rather than months, without contested litigation.

Intervention categories include: I-9 and document issues; E-Verify; Temporary Protected Status and Deferred Enforced Departure; asylee/refugee issues; citizenship status discrimination and national origin discrimination.

This document provides resources on employment rights for refugees and asylees, including information on payroll and tax forms, Form I-9, E-Verify, protections against discrimination and unfair treatment, and more.
