Acting DHS Secretary Benjamine Huffman issued a memo to ICE, CBP, and USCIS titled, “Guidance Regarding How to Exercise Enforcement Discretion” that outlines how to exercise enforcement discretion in implementing two new policies.

Acting DHS Secretary Benjamine Huffman issued a memo to ICE, CBP, and USCIS titled, “Guidance Regarding How to Exercise Enforcement Discretion” that outlines how to exercise enforcement discretion in implementing two new policies related to his 1/20/25 memo entitled “Exercising Appropriate Discretion Under Parole Authority,” which clarifies DHS’s position regarding the scope of the parole statute and directs a variety of actions to implement the memo, and the 1/24/25 DHS notice entitled “Designating Aliens for Expedited Removal,” which expands the scope of expedited removal to the statutory maximum.
