DHS Issues Guidance on How to Exercise Enforcement Discretion

Acting DHS Secretary Benjamine Huffman issued a memo to ICE, CBP, and USCIS titled, “Guidance Regarding How to Exercise Enforcement Discretion” that outlines how to exercise enforcement discretion in implementing two new policies related to his 1/20/25 memo entitled “Exercising Appropriate Discretion Under Parole Authority,” which clarifies DHS’s position regarding the scope of the parole statute and directs a variety of actions to implement the memo, and the 1/24/25 DHS notice entitled “Designating Aliens for Expedited Removal,” which expands the scope of expedited removal to the statutory maximum.
