DOJ Issues Memo on Interim Policy Changes Regarding Charging, Sentencing, and Immigration Enforcement

Acting Deputy Attorney General Emil Bove issued a memo for all DOJ employees regarding interim decisions and policy changes pending confirmation of the Attorney General. The memo states that, effective immediately, the DOJ’s interim policy regarding charging and sentencing is set forth in the 5/10/17 memorandum entitled “Department Charging and Sentencing Policy,” which applies to all charging decisions at the DOJ and the U.S. Attorney’s Offices, and that any inconsistent previous policy of the DOJ relating to charging and sentencing policy is rescinded. The memo also discusses the core principle of pursuing the most serious, readily provable offense and the “faithful execution of the immigration laws.”
