Executive Order on Removing Barriers to American Leadership in Artificial Intelligence

This executive order (EO) revokes certain existing artificial intelligence (AI) policies and directives following the revocation of a 10/30/23 EO that recommended policies to facilitate access to O-1, EB-1, EB-2, and entrepreneur parole visa options for foreign nationals with AI expertise.

This executive order (EO) revokes certain existing artificial intelligence (AI) policies and directives following President Trump’s 1/20/25 revocation of President Biden’s 10/30/23 EO 14110 on artificial intelligence (AI), which recommended policies to facilitate access to O-1, EB-1, EB-2, and entrepreneur parole visa options for foreign nationals with AI expertise.

The EO instructs certain heads of executive departments and agencies, within 180 days of the order, to identify any actions taken pursuant to EO 14110 that are or may be inconsistent with “sustain[ing] and enhanc[ing] America’s global AI dominance in order to promote human flourishing, economic competitiveness, and national security.” For any such agency actions identified, the heads of agencies are instructed to suspend, revise, or rescind such actions, or propose suspending, revising, or rescinding such actions.

At present, it is unclear whether this EO will in fact rescind certain O-1, EB-1, EB-2, and entrepreneur parole policies. AILA will be closely tracking any developments.
