USCIS Clarifies Guidance for Filing DACA Applications
USCIS issued an update after a U.S. district court decision found the DACA final rule unlawful. USCIS will continue to accept and process DACA renewals and accompanying applications for EADs. USCIS will continue to accept initial requests, but per the order, not process initial DACA requests.
On September 13, 2023, after Judge Hanen issued his decision, the Secretary of Homeland Security Alejandro N. Mayorkas released the following statement:
“Consistent with the ruling, USCIS will continue to process DACA renewals, and DHS will continue to advocate on behalf of DACA recipients every day, in the courts and through our actions. We stand ready to work with Congress on an enduring solution for our Dreamers.”
