USCIS Issues Guidance on SIJ Tolling Provisions

USCIS issued guidance to align with Casa Libre/Freedom House v. Mayorkas, a district court decision that found that the tolling provisions outlined in DHS regulations were not in accordance with the 180-day timeframe for the adjudication of a special immigrant juvenile petition as required. Guidance is effective as of 11/8/23. Comments are due by 12/8/23.
