USCIS Provides Guidance on Paying Fees and Completing Information for Form I-140
USCIS issued a reminder to provide the correct payment and complete information when filing Form I-140. Since publishing a new edition of this form and new filing fees, USCIS has rejected an unusually high number of forms at intake because of incorrect fees or missing information.
Following AILA’s inquiry to USCIS for clarification on continued Form I-140 rejections, USCIS issued this guidance to determine when the Asylum Program Fee is required. This guidance is based on the response to questions 5 and 6 on Part 1. USCIS noted that a lack of response to these questions may lead to rejections due to the inability to determine if the Asylum Program Fee is required.
AILA further reminds members that case assistance is not possible for cases where the form was not properly filled out. Thus, members are encouraged to double-check forms before filing with USCIS.
