USCIS Releases Policy Memo on Issuance of NTAs in Cases Involving Inadmissible and Removable Noncitizens

USCIS released a policy memorandum that will be used to guide the issuance of Notices to Appear (NTAs) by all USCIS employees in cases involving inadmissible and removable noncitizens. The memo states that USCIS will no longer exempt classes or categories of removable noncitizens from potential enforcement, which includes referring cases to ICE and the issuance of NTAs. The memo includes information on NTA issuance required by statute or regulation, national security cases, criminal cases, fraud and misrepresentation, Temporary Protected Stats (TPS), noncitizens not lawfully present in the United States, special circumstances involving NTA issuance, prosecutorial discretion, and more.
