DOL WHD Issues Bulletin on H-1B Program Obligations for Common-Law Employers
On 1/15/21, DOL Wage and Hour Division (WHD) issued a bulletin clarifying that when a primary employer places an H-1B worker with a secondary employer that is a common-law employer, both employers must comply with their respective LCAs and the corresponding H-1B program obligations.
Note: On January 20, 2021, this bulletin was withdrawn by DOL.
