Removal defense has become paramount during the second Trump Administration. For foreign nationals who have lived in the United States for many years, cancellation of removal (COR) will be the principal (and most common) form of relief. Panelists will explore complicated issues in COR cases, including meeting the exceptional and extremely unusual hardship standard for non-lawful permanent resident (LPR) COR, the seven-year accrued residence for LPR COR, and the battery or extreme cruelty requirement for VAWA COR.
Featured Topics:
- Bars to COR, including criminal bars and good moral character
- Stop-time rule for convictions and service of compliant Notices to Appear (NTAs)
- Hardship standard: exceptional and extremely unusual vs. extreme hardship
- Qualifying relatives and aging out
- Bigamy in VAWA COR cases
- Discretion
