Federal regulations require that an EB-5 investor must submit evidence demonstrating that the EB-5 capital investment funds were “obtained through lawful means.” Documenting how an immigrant investor earned and transferred the funds to an EB-5 project is critical to establishing eligibility and a major part of an EB-5 attorney’s job, as USCIS has created stringent requirements for compliance.
