Since the last edition of this book, worksite enforcement has surged at both federal and state levels. By 2024, 26 states have enacted employer sanctions laws, with nine mandating E-Verify for all eligible employers and 12 requiring it for contractors engaged in state or local government projects. Other states have implemented immigration laws pertaining to employers, some without E-Verify requirements. Companies now face severe penalties, such as license revocation and contract denial, if found hiring unauthorized workers.
The enforcement of employer sanctions and anti-discrimination regulations under the Immigration Reform and Control Act (IRCA) falls under the jurisdiction of two agencies: U.S. Immigration and Customs Enforcement (ICE) and the Immigrant and Employee Rights Section of the Civil Rights Division at the Department of Justice. Bruce E. Buchanan is special counsel at Littler Mendelson’s Nashville office. Bruce counsel’s employers on immigration compliance issues, conducts internal I-9 audits, represents employers in U.S. Immigration and Customs Enforcement (ICE) inspections/audits and Immigrant and Employee Rights (IER) investigations, and on employment-based visas. Bruce practices labor law where he represents employers before the National Labor Relations Board (NLRB), in collective bargaining, and before the U.S. Department of Labor’s Wage & Hour Division.
Prior to joining Littler, Bruce was at three other law firms in Nashville, including Siskind Susser, where he practiced immigration law and labor law. Prior to entering private practice in 2003, Bruce was a senior trial specialist for the NLRB for 20 years.
Bruce is a frequent speaker on immigration compliance and labor law issues before numerous organizations, including American Immigration Lawyers Association (AILA), Associated General Contractors (AGC), Tennessee Bar Association (TBA), SHRM, Tennessee Bankers Association, and American Payroll Association. Bruce has served for five years on AILA’s Verification & Documentation Liaison Committee. He also frequently writes on immigration compliance issues for Littler.
For 12 years, Bruce served as adjunct professor at the University of Arkansas at Little Rock William H. Bowen School of Law. He is also the past-chair and past editor of TBA’s Immigration Law Section.
Bruce received his J.D. from Vanderbilt University School of Law in 1982 and his B.S., magna cum laude, from Florida State University in 1979.
Greg Siskind is a founding partner of Siskind Susser PC (www.visalaw.com) and is one of America’s best-known immigration attorneys. He founded Siskind Susser in 1994, and the firm represents employers across the country on immigration matters.
Because of Greg’s expertise, he has authored many pieces of immigration-related legislation and has testified as an expert before the U.S. Congress’s House of Representatives Immigration Subcommittee. He has authored several books.
