Earlier in FY 2025, USCIS implemented its “beneficiary-centric” selection process for registrations by employers. What have immigration attorneys learned since? Should practitioners approach anything differently for the FY2026 H-1B cap season? The expert faculty on this seminar will discuss the H-1B lottery system and address other general issues for filing FY2026 cap-subject cases based on the current landscape, including updated Standard Occupational Classification (SOC) categories and wages.

Featured Topics:

  • Lessons learned from the previous H-1B cap season, including the new “beneficiary-centric” registration system
  • Issues with electronic registration (“handshake”), pay.gov, and receipt of selection notices online
  • Responding to client questions regarding cap gap, odds of selection, and more
  • Preparing and/or filing the labor certification application (LCA), identifying the SOC, and prevailing wage issues: new request for evidence (RFE) templates for LCA SOC Codes
  • Strategies for unexpected second and third round selections
