How the Trump Administration Broke the Immigration Court System

4/19/21 AILA Doc. No. 13040204. Removal & Relief

In just four years, the Trump administration implemented radical changes that fundamentally compromised the integrity of the immigration courts and their ability to ensure fairness and impartiality. The administration pressured judges to render decisions at a break-neck pace at the cost of accuracy, while stripping them of their ability to control their dockets. EOIR policies—including hiring practices, docket interference, and attempts to terminate the immigration judges’ union—politicized the immigration courts more than ever before.

Through hundreds of policies, including those listed below, the Attorney General and the Executive Officer for Immigration Review (EOIR) transformed the immigration courts into an enforcement agency rather than a fair and neutral arbiter.

AILA’s New Jersey Chapter Seeks to Enjoin Newark Immigration Court from Compelling In-Person Proceedings – July 31, 2020
- On August 7, 2020, the AILA New Jersey Chapter filed a motion for preliminary injunction, as well as a brief in support of the motion, requesting the court to issue a Preliminary Injunction prohibiting EOIR from compelling attorneys to attend in-person proceedings at the Newark Immigration Court.
NAIJ Files Lawsuit Challenging Unconstitutional Prior Restraint on the Speech of Immigration Judges (Nat'l Ass'n of Immigration Judges v. McHenry, No. 1:20-cv-00731 (E.D. Va.)). – July 1, 2020
- On August 6, 2020, the District Court held that it lacked jurisdiction over NAIJ's claims and accordingly denied the motion for a preliminary injunction. Now pending possible appeal.
AILA, the Immigration Justice Campaign, the National Immigration Project of the National Lawyers Guild, and several detained individuals filed suit to demand EOIR and ICE take actions to prioritize health and safety during the COVID-19 pandemic (NIPNLG et al., v. ICE, 3/30/20)

On December 18, 2019, several organizations filed a lawsuit challenging the weaponization of the nation’s immigration court system to serve the Trump administration’s agenda. The lawsuit contests the perpetuation of immigration court jurisdictions where asylum is effectively impossible to win, the creation of a backlog of more than a million immigration cases, the implementation of enforcement-oriented performance metrics for immigration judges, and the implementation of a rapid-removal family docketing directive. On July 31, 2020, the judge denied the government’s motion to dismiss, allowing the case to go forward. For more information, see Las Americas v. Trump.
