On February 11 2019, USCIS announced that
it had revised the form I-539 which is
0:00:11.540–0:00:15.360
the form that is used by individuals to
extend or change their non-immigrant
0:00:15.360–0:00:20.640
status in the United States. USCIS has
indicated that it plans to publish the
0:00:20.640–0:00:28.160
revised form I-539 on the USCIS website
on March 11 2019. As of that date
0:00:28.160–0:00:34.600
March 11 2019, USCIS will only accept the
revised form I-539 and will reject
0:00:34.600–0:00:39.620
any other prior editions of the form.
USCIS also announced that it will be
0:00:39.629–0:00:46.260
publishing a new form I-539A which will
replace the prior supplement A that was
0:00:46.260–0:00:50.280
provided in previous
versions of the form I-539.
0:00:50.280–0:00:54.620
And the revised form I-539
includes significant changes
0:00:54.620–0:00:57.420
including a new requirement
that every applicant
0:00:57.420–0:01:02.040
and co-applicant pay a
new $85 biometrics fee
0:01:02.040–0:01:07.940
and as part of the I-539 process
attend a biometric services appointment.
0:01:07.940–0:01:14.220
And this requirement applies to all applicants
including children regardless of age.
0:01:18.260–0:01:24.080
First from a timing standpoint, AILA's
concern at the speed with which USCIS is
0:01:24.080–0:01:28.180
rolling out this new form and the fee and
the process that go with it.
0:01:28.180–0:01:33.160
In contrast to the agency's long-standing policy
and practice for introducing new forms.
0:01:33.160–0:01:37.500
Here there's no grace period where
the agency will it accept both the new
0:01:37.500–0:01:40.300
version of the form and prior editions
of the form.
0:01:40.300–0:01:44.460
And this greatly disadvantages applicants
who may not be aware of the changes
0:01:44.460–0:01:48.980
in the forms, in the process especially those
who are not represented by lawyers.
0:01:48.980–0:01:53.160
AILA is also concerned that the new
addition of the form I-539 will be released
0:01:53.160–0:01:57.680
on the same day that it's made mandatory
and these issues are particularly
0:01:57.680–0:02:00.980
burdensome on our members
and our clients given that
0:02:00.980–0:02:05.940
the March 11 implementation date
of this new I-539 form falls
0:02:05.940–0:02:10.040
at the height of the H-1B cap
preparation season.
0:02:14.100–0:02:16.620
Today AILA National with the help of
0:02:16.620–0:02:20.500
AILA's USCIS Headquarters
Liaison Committee sent a letter to
0:02:20.500–0:02:27.300
USCIS director Francis Cissna requesting
that USCIS delay the March 11th 2019
0:02:27.300–0:02:33.500
effective date for the revised form I-539.
In the letter AILA is asking USCIS
0:02:33.500–0:02:39.120
to institute a 90 day grace period
until June 9th 2019
0:02:39.120–0:02:41.670
where it will continue to accept the current
0:02:41.670–0:02:45.560
version of the form I-539 and the
supplement A so that we can have
0:02:45.560–0:02:50.720
an orderly transition to the new form
and not unnecessarily disrupt the filing
0:02:50.730–0:02:56.040
process during this year's H-1B cap
season. In addition AILA is requesting
0:02:56.040–0:03:01.459
that USCIS suspend the new mandatory
biometrics requirement and fee for all
0:03:01.460–0:03:07.220
I-539 applicants until the public has had
a meaningful opportunity to comment
0:03:07.220–0:03:10.640
on the burdens imposed by this new
requirement.
0:03:10.640–0:03:14.840
AILA will continue to monitor this issue
and we will update our practice pointer
0:03:14.840–0:03:17.980
and our members as more
information becomes available.
0:03:17.980–0:03:20.040
Thank you.
